WASHINGTON TOXICS COALITION “TOXIC TRUTH” CONTEST (“CONTEST”)
OFFICIAL RULES


1.    Eligibility.  NO DONATION NECESSARY TO ENTER OR WIN; DONATION WILL NOT INCREASE ODDS OF WINNING.  CONTEST OPEN ONLY TO RESIDENTS OF WASHINGTON STATE.  IF YOU ARE NOT A RESIDENT OF WASHINGTON STATE, YOU ARE NOT ELIGIBLE TO WIN A PRIZE, AND WASHINGTON TOXICS COALITION. ("SPONSOR") RESERVES THE RIGHT NOT TO AWARD A PRIZE TO YOU.  To be eligible to win a prize pursuant to the Contest, entries must be completed and received by Sponsor in the format designated below.  Sponsor and any of its directors, officers, professional advisors, or, employees, and immediate families of each are not eligible to win any prizes.  All applicable federal, state and local laws and regulations apply.  Offer void where prohibited.  Participation limited to only those entrants who submit a valid entry (each, a "Contestant").


2.    Disclaimer.  Washington Toxics Coalition will not be responsible for: (a) any late, lost, misrouted, garbled or distorted or damaged transmissions or entries; (b) telephone, electronic, hardware, software, network, Internet, or other computer- or communications-related malfunctions or failures; (c) any Contest disruptions, injuries, losses or damages caused by events beyond the control of Sponsor; or (d) any printing or typographical errors in any materials associated with the Contest.


3.    Entry Period.  The entry period ("Entry Period") for the Contest is from 10:00 a.m. Pacific Time on September 24, 2008 to 5:00 p.m. Pacific Time on November 3, 2008.  All Contestants must be entered by 5:00 p.m. Pacific Time on November 3, 2008 to be eligible to win a Grand Prize.


4.    Prizes. 
(a) Grand Prize: One (1) Grand Prize will be awarded to each of four (4) Contestants, one from each of four geographical areas of Washington state as determined by Washington Toxics Coalition, who is judged to have submitted the best Story (as defined below) about why their house should be evaluated for toxic chemicals.  Each Grand Prize will consist of the winning Contestant receiving two hours of in-home testing by the Washington Toxics Coalition with an XRF analyzer between November 3, 2008 and December 15, 2008.  The retail value for a Grand Prize is $450.
 (b) Odds of Winning.  Odds of winning a Grand Prize will depend on the number of valid entries received by Participants and the quality and aptness, as judged by Sponsor, of each Contestant's entry.  Odds of winning a Participant Prize will depend on the number of entrants who submit a valid entry.
ALL FEDERAL, STATE AND LOCAL TAXES ASSOCIATED WITH THE RECEIPT OR USE OF ANY PRIZES ARE THE SOLE RESPONSIBILITY OF THE WINNERS.
All prizes will be awarded, except as set forth in Section 6(d), below.  Prizes are not transferable.  No substitutions or exchanges (including for cash) of any prizes will be permitted, except that Sponsor reserves the right to substitute a prize of equal or greater value for any prize.  Limit one prize per Contestant.  All prizes are awarded "AS IS" and WITHOUT WARRANTY OF ANY KIND, express or implied, (including, without limitation, any implied warranty of merchantability or fitness for a particular purpose).

 

5.    How to Enter.  To enter, complete all required blank fields in the Contest entry form at http://org2.democracyinaction.org/o/5121/t/2768/signUp.jsp?key=406 during the Entry Period.  Only valid entries will be accepted and eligible to win prizes.  Entrants may submit only one entry.  All valid entries from Contestants will be considered for purposes of determining the Grand Prize winners.  By entering the Contest, you consent to having your story published on the Washington Toxics Coalition’s website and having your name and story used in press materials and promotional materials.  By entering the Contest, you consent to participating in a press event to publicize the results of the in-home testing conducted by the Washington Toxics Coalition.

6.    Contest Rules.
(a) Each entrant must complete all required Contest entry blank fields, including submitting his or her Story.  A “Story” may be submitted in written form or video form. Videos must be posted on www.youtube.com and a link to the video must be supplied with entry. A "Story" is a narrative about why Contestant’s home should be evaluated for toxic chemicals by the Washington Toxics Coalition.  Each Story must be in the form of an original narrative written by the entrant, and must be suitable for all audiences (e.g., of a subject matter and utilize language appropriate for display on Sponsor's website and in other public settings), as Sponsor may determine in its sole discretion.
(b) Sponsor will select entrants to be Contestants in the order in which valid entries are received by Sponsor during the Entry Period, until two hundred (200) Contestants are selected or the Entry Period terminates, whichever occurs sooner. 
(c) Sponsor will evaluate the creativity, appropriateness, and entertainment value of each Story submitted by Contestants and choose the Grand Prize winners.  Sponsor will determine the Grand Prize winners based on the criteria described above and based on the most apt, original and interesting Stories.  This determination shall be made in the sole discretion of Sponsor, and shall be final.
(d) On or before November 17, 2008, Sponsor will notify the eligible entrants who have won a prize. Grand Prize winners may be selected and announced at any time after the Entry Period.  Grand Prize winners will be notified by email or phone call using the information provided to Sponsor in the entry form.  Each Contestant to be awarded a Grand Prize must acknowledge his or her Grand Prize within seven (7) days of notification, or such later date as may be specified in the notification (in either case, the "Claim Deadline").  After the Claim Deadline has expired for a particular Grand Prize, Sponsor may, in its own discretion, award or refuse to award the unacknowledged Grand Prize.


7.    Sponsorship Ownership of Entries.  All entries and materials submitted to Sponsor in connection with the Contest (collectively, "Entry Materials"), along with all copyright, trademark and other proprietary rights associated therewith, become the property of Sponsor upon submission, and Entry Materials will not be returned to any entrant.  Without limiting the generality of the foregoing, you acknowledge that Sponsor will own all rights to use, modify, reproduce, publish, perform, display, distribute, make derivative works of and otherwise commercially and noncommercially exploit the Entry Materials in perpetuity and throughout the universe, in any manner or medium now existing or hereafter developed, without separate consideration to you or to any other person or entity.  You agree to take, at Sponsor's expense, any further action (including, without limitation, execution of affidavits and other documents) reasonably requested by Sponsor to effect, perfect or confirm Sponsor's ownership rights as set forth in this paragraph 7.


8.    Original Work of Authorship.  You hereby warrant and represent that (a) you own all rights to all Entry Materials submitted by you; and (b) all such Entry Materials are original works of authorship on your part and have not been copied, in whole or in part, from any other work and do not violate, misappropriate or infringe any copyright, trademark or other proprietary right of any other person or entity.


9.    General Release.  By entering the Contest, you release the Sponsor from any liability whatsoever, and waive any and all causes of action, related to any claims, costs, injuries, losses, or damages of any kind arising out of or in connection with the Contest or delivery, misdelivery, acceptance, possession, use of or inability to use any prize (including, without limitation, claims, costs, injuries, losses and damages related to personal injuries, death, damage to or destruction of property, rights of publicity or privacy, defamation or portrayal in a false light, whether intentional or unintentional), whether under a theory of contract, tort (including negligence), warranty or other theory.


10.     Use of Winner's Name, Likeness, etc.  Except where prohibited by law, entry into the Contest constitutes permission to use each and every winner's name, address, likeness and/or prize information, without limitation, for promotional purposes without further permission or compensation, including, without limitation, use on or in connection Sponsor’s website.  As a condition of being awarded any prize, except where prohibited by law, winners may be required to execute a consent to the use of their name, address, likeness and/or prize information, without limitation, for promotional purposes without further permission or compensation.


11.    Affidavit & Release.  As a condition of being awarded any prize, winners may be required to execute and deliver to Sponsor a signed affidavit of eligibility and acceptance of these Official Rules and release of liability.


12.    Winners List; Rules Request.  For a copy of the winners list, send a stamped, self-addressed, business-size envelope after November 1, 2008 and no later than July 1, 2009 to Sponsor at the address listed below, Attn: Toxic Truth Sleuth Contest.  To obtain a copy of these rules, send a stamped, self-addressed business-size envelope to Sponsor at the address listed below, Attn: Toxic Truth Sleuth Contest.

13.    Miscellaneous.  The Contest and these Official Rules will be governed, construed and interpreted under the laws of the state of Washington.  Entrants agree to be bound by these Official Rules and by the decisions of Sponsor, which are final and binding in all respects.  Sponsor reserves the right to change these Official Rules at any time, in its sole discretion, and to suspend or cancel the Contest or any entrant's participation in the Contest should viruses, bugs, unauthorized human intervention or other causes beyond Sponsor's control affect the administration, security or proper play of the Contest or Sponsor otherwise becomes (as determined in its sole discretion) incapable of running the Contest as planned.  Entrants who violate these Official Rules, tamper with the operation of the Contest or engage in any conduct that is detrimental or unfair to Sponsor, the Contest or any other entrant (in each case as determined in Sponsor's sole discretion) are subject to disqualification from entry into the Contest.  Sponsor reserves the right to lock out persons whose eligibility is in question or who have been disqualified or are otherwise ineligible to enter the Contest.  If you have any questions about these Official Rules or the Contest, please e-mail them to adavis@watoxics.org or send written questions to Washington Toxics Coalition, Attn: Toxics Truth Sleuth Contest, 4645 Sunnyside Ave N., #510E, Seattle, WA 98103.
